Judge denies Lexicon publisher access to J.K. Rowling's notes (UPDATED) There is more information today about the ongoing legal battle between Warner Bros./J.K. Rowling and RDR Books/Harry Potter Lexicon. In preparation for its case, RDR asked J.K. Rowling to hand over, among other things, her notes from her seven Harry Potter books, Scholastic and Bloomsbury’s notes from the books, and "further material from Ms. Rowling’s creative mind" in an effort to determine "how far Ms. Rowling had progressed in this project…how similar, and thus how competitive, Ms. Rowling’s guide, and the Lexicon, were likely to be." A judge has denied the requests, stating RDR has "not shown the Court that any further discovery about Ms. Rowling’s notes would be helpful to Defendant’s position." The judge has, however, asked Rowling to submit statements she has made previously in publications in regard to plans for her encyclopedia. RDR has also asked for an additional three days to file their reply, which was due today, to address the complaint filed by Warner Bros. and Rowling. It is now due on Feb. 8. They object to RDR's, “pattern of writing the Court whenever it wishes without first making any effort to meet and confer, let alone giving sufficient advance notice of its intended communication with the Court.” They have called their attempt to claim notes, “extremely burdensome and unnecessary for the resolution of any issue in this case, particularly in light of Ms. Rowling’s interrogatory responses and the documents that Plaintiffs produced in support of their motion for preliminary injunction.” Quote:

Personally, I don't think the Lexicon has any right to any of JK Rowlings ideas' notes' or conversations...Harry Potter belongs to HER, came from HER brain, and she has all rights to him.....This guy is just trying to earn a buck and make a name for himself. yes j.k rowling made harry potter it's her ideas and she made it :( and she has her own notes that he try's to pretty much copy from her dude so yea he should get another buddy lol |
this is really a tough case. Lexicon is kinda like an unpublished dictionary but they do site that HP is not theirs, right? it's Jo's decision whether or not she'll create and publish an encylopaedia, but as for Lexicon to get published, I say nay... |

J.K has the right to publish her own encyclopiedia when she's finished it. They have no right to take her idees and interviews and stuff to publish. I'ts like steeling. Jo has right. |

This is a tough case, but I think that Jo should have the right to publish her encyclopedia without having a knock-off on the market. It all comes down to the fact that they would be making money off her ideas and information without adding any of their own. I know I certainly would rather buy an encyclopedia written by Jo herself and know that my money is going to charity than buy an encyclopedia by some guys who just want to mooch off of her. And as for asking to see her personal notes, give me a break. That's just ridiculous. |
*Runs off and slaps the Lexicon* Ok, yes the Lexicon is the greatest Harry potter Reference I have seen yet, but that's because JK's isn't published yet. I mean come on Lexicon guy get a life and a real Job and leave Harry to the Geinius who created him for merlin's sake! |
wow... this is just getting dumb. <_< Lexicon is ruining their reputation and fan base. They're a great site... I just wish they hadn't taken their ideas to this level. Wasn't Jo's recognition on her site enough? They should have just left her to do her own Encyclopedia on her own time. All proceeds going to charity. |

That really sucks. I was totally sympathizing with both sides, the fact that they want Jo's notes to argue how similar the encyclopedia will be to a print Lexicon is ridiculous. Dude, no means no. |
This is just silly. He may as well have just admitted that he's stealing her ideas. Like everyone else here has said, they belong to her. And why would he even bother to publish anything and charge people for it when they can get it for free on the website? Waste of court time and money. How this is even legal, I don't know. |

There are resourse books written by others concerning many great authors. There are companions for the Narnia books and LOTR books, these were not written by Lewis or Tolkien. It’s a tough call as to whether there is copyright infringement on the part of the Lexicon and I think it will be a long time before the issue is resolved. The longer it goes on the better for Rowling because it allows her time to organize her own resource book. If she completes it and publishes before the Lexicon this case becomes a moot point. Personally if I knew the publication date for the Rowling book there would be no way I would spend money on the Lexicon book. I would think Rowling's book would be a better buy because it would be more indepth. |
^ In such instances, it is down to the individual authors and publishers to allow publication. They're not obliged to do so, and doing so doesn't make said publication affiliated or official. At the end of the day, Jo owns the copyright. It's her call. Quote:
